Classes Online, LLC ("ClassForThat", "ClassForThat.com,", "website", "site", "applications", "apps", "platform", "we," "our", or "us") values your privacy. We are committed to protecting your online privacy and safety. In this privacy policy, among other important issues, we describe the information we collect, how we use it, and when and with whom we share it. This privacy policy applies to all ClassForThat websites, sites, services, applications, apps, classes, materials and other online services (collectively, "Platform") made available by ClassForThat. This privacy policy applies only to information collected on or through our Platform. It does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person, over the telephone and/or by mail, or from third parties outside the Platform).

Please understand that by submitting any information to us, you acknowledge that we may collect, use, disclose and retain such information in accordance with this privacy policy and our terms of use, and as permitted or required by law.

Information about others

If you request that your purchase be provided to someone other than yourself (such as a gift recipient), we use the information you provide about the other person to fulfill the order.

 

If you access the Platform through a third-party connection or log-in (e.g., through a social network like Facebook, Amazon or Twitter), you may allow us to have access to and store certain information from your social network profile. This can include your name, gender, profile picture, your "likes" and check-ins, and your list of friends, depending on your settings on such services. If you do not wish to have this information shared, do not use a social networking connection to access the Platform.

For a description of how social networking sites handle your information, please refer to their privacy policies and terms of use, which may permit you to modify your privacy settings. You may also have the option of posting your activities to social networks when you access the Platform through them (for example, you may post to Facebook that you will take a certain class on the Platform); you acknowledge that if you choose to use this feature, your friends, followers and/or subscribers on any social network you have enabled will be able to view such activity.

 

We may receive additional information such as demographic and statistical information from third parties, such as business partners, marketers, researchers, analysts, and other parties that we may attribute to you based on your assignment to certain statistical groups. We use this information to supplement the information that we collect directly from you in order to derive your possible interests and to provide more relevant experiences and classes for you and improve our products, analytics, and advertising.

 

When you use our Platform, we collect certain information as described in this Section. As discussed further below, we and our service providers (which are third party companies that work on our behalf) may use a variety of technologies, including cookies and similar tools, to assist in collecting this information.

 

When you use our Platform through a mobile device, via any of our websites, sites, software or mobile applications, we and our service providers may automatically collect general location information (e.g., IP address, city, state and/or postal code associated with an IP address) from your computer or mobile device and analyze information such as your browser types, browser language, operating system, software and hardware attributes (including device identifiers) referring and exit pages and URLs, the number of clicks, pages viewed, the order of those pages, time spent in each section and where are you clicking, the date and time you used the Platform, error logs, and other similar information. We also automatically receive and collect certain information about the mobile phone, tablet, or computer used to access the Platform, including Internet service provider, domain name, usage data, mobile carrier and other similar information, whether and when you update the Platform, and how you use the Platform.

 

If you have opted-in to share your precise location with us, you can turn off the collection of precise location information through your device settings. We may still be able to infer your approximate location through other information we collect, such as IP address. You agree that ClassForThat may store and use that information for security purposes (for example, for user verification and to ensure that ClassForThat’s APIs are being used appropriately). You also acknowledge and agree that use of the Platform through a mobile device may cause data to be displayed on and through your mobile device which may be viewed by your mobile carrier and/or other access provider(s).

 

Cookies and data collection tools

We use tools like cookies, web beacons, analytics services, and advertising providers to gather information about you.

 

We and service providers acting on our behalf (like Google Analytics and third-party advertisers) use server log files and automated data collection tools like cookies, tags, scripts, customized links, device or browser fingerprints, and web beacons (together, "Data Collection Tools") when you access and use the Platform. These Data Collection Tools automatically track and collect certain system data and usage data when you use the Platform. In some cases, we tie data gathered through those Data Collection Tools to other data that we collect.

 

We use cookies to help create a better user experience. A cookie is a small text file that websites send to your device to uniquely identify your browser or device or to store data in your browser or device. The cookies may be stored on your device hard drive. Cookies are used for things like analyzing your use of the Platform, personalizing your experience, making it easier to log into the Platform, and recognizing you when you return. While you may elect to disable or delete cookies from your browser or device at any time, please note that this action may limit the ease of your use of our Platform that uses cookies.

 

We also use web beacons, small objects that allow us to measure the actions of visitors and users using our Platform, for things like identifying whether a page was visited, identifying whether an email was opened, and advertising more efficiently by excluding current users from certain promotional messages or identifying the source of a new mobile app download.

You can set your web browser or device to alert you about attempts to place cookies on your computer or device, limit the types of cookies you allow, or refuse cookies altogether. If you do, you may not be able to use some or all features of the Platform, and your experience may be limited.

Some of the third-party partners who provide certain features on our site may also use local storage objects (also known as flash cookies or LSOs) to collect and store data.

 

Additional Technologies

We may also use additional technologies such as pixel tags, web beacons, tracers, tracking scripts, clear GIFs and other technologies, and may permit our third-party service providers to use these technologies. We use these technologies for purposes such as measuring the effectiveness of our advertisements or other communications, determining viewing and response rates, and determining which offers to present to you on our own or on third party sites.

 

Analytics

We use third-party browser and mobile analytics services like Google Analytics and others on the Platform. These services use data collection tools to help us analyze your use of the Platform, including information like the third-party website you arrive from, how often you visit, events within the Platform, usage and performance data, and from where the application was downloaded. We use this data to improve the Platform, better understand how the Platform performs on different devices, and provide information that may be of interest to you. We do not link the information we store within the analytics software to any personally identifiable information you submit within the Platform.

 

We use all features of Google Analytics for display advertisers. That includes obtaining specific user cookie data, such as the source, medium and keyword used to visit our Platform. Google analytics does not store any user specific data and we will not use user specific data in any way related to Google Analytics, Google Adwords, and Remarketing.

Third-party vendors use first-party cookies (such as the Google Analytics Cookie) and other third-party cookies (such as the DoubleClick cookie) together to inform, optimize and serve ads based on user’s past visits to our Platform.

Users can choose to opt-out of Google Analytics for Display Advertisers and opt-out of customized Google Display Network ads by visiting the Ads Preferences Manager.

 

Online Advertising

We use third-party advertising services like Double click, Facebook, Google’s ad services, and other ad networks and ad servers to deliver advertising about our Platform on other websites and applications you use. The ads may be based on things we know about you, like your usage data and system data and things that these ad service providers know about you based on their tracking data. The ads can be based on your recent activity or activity over time and across other sites and services and may be tailored to your interests.

Depending on the types of advertising services we use, they may place cookies or other tracking technologies on your computer, phone, or other device to collect data about your use of our Platform and may access those tracking technologies in order to serve these tailored advertisements to you. To help deliver tailored advertising, we may provide these service providers with a hashed, anonymized version of your email address (in a non-human-readable form) and content that you share publicly on the Platform.

When using mobile applications, you may also receive tailored in-app advertisements. Apple iOS and Android OS each provide their own instructions on how to control in-app tailored advertising. For other devices and operating systems, you should review your privacy settings.

ClassForThat cares about the integrity and security of your personal information. We keep your personal information in encrypted form on a secured server behind a firewall. We might also use automated and social measures to enhance security, such as analyzing account behavior for fraudulent or otherwise anomalous behavior, may limit use of Platform features in response to possible signs of abuse, may remove inappropriate content or links to illegal content, and may suspend or disable accounts for violations of our Terms of Use or Privacy Policy. Please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share on our Platform will not become publicly available. We are not responsible for third-party circumvention of any privacy settings or security measures on our Platform. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different websites and applications. ClassForThat is not responsible for the functionality or security measures of any third party.

We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the Platform and for various purposes depending on the types of information we have collected from and about you and the specific services you use, in order to:

 

 

Combined information

We may combine the information that we collect through the Platform with information that we receive from other sources, both online and offline, and use such combined information in accordance with this privacy policy.

 

Personal information

We do not share your personal information with third parties for their marketing purposes without your consent. We may share non-personal information, such as aggregate user statistics, de-identified information, demographic information, and usage information with third parties, including advertisers, content providers, promotional partners, sponsors and analytics providers; and third parties may collect non-personal information when you use the Platform. Demographic information may include information related to your gender, age, education and other. We may create de-identified information by removing all information that can be used to directly identify or contact you as a specific individual, such as your name and email address. We may also share your personal information with third parties with your consent, as disclosed at the time you provide us with such information.

 

We may use de-identified information for any purpose, including without limitation for research and marketing purposes and statistical analyses of Platform usage.

 

When you request that we share your information

We may offer opportunities and features through the Platform that are brought to you by a third party or that otherwise involve sharing your information with a third party. If you request or agree at that time to have your information shared, your information will be disclosed to that third party (or parties) and will be subject to the privacy policy and practices of that third party. This includes, without limitation, instances in which you use our Platform to purchase products, classes or services provided, in whole or part, by third parties. You also may request, sometimes through your use of an interactive feature or social media feature, that we share information about you with a third party or publicly, and we will typically do so under those circumstances.

 

Service providers

We will share your personal information with third parties to provide services to us or you in connection with the Platform, but subject to confidentiality obligations, which limit their use and disclosure of such information. For example, we may provide your personal information to companies that provide services to help us with our business activities, such as shipping anything to you, sending our emails, or offering customer service. If you purchase any products, classes or services, our billing partner will receive billing and financial information (e.g., credit card numbers) necessary to process your charges, including your postal and e-mail addresses, depending on your payment method.

 

Administrative, legal reasons & academic integrity investigations

We may also disclose your information, including personal information, in response to a subpoena or when required by law; in response to bankruptcy proceedings; to defend our rights; in response to a written request from law enforcement regarding an investigation into criminal activity that may have occurred through or in any way using ClassForThat’s Services, Platform or property; to provide information to a claimed owner of intellectual property who claims that content you have provided to us infringes on their rights; upon request of an academic institution connected to an investigation into academic integrity; to protect and/or defend any applicable Terms of Use or other policies applicable to the Platform; or to protect the personal safety, rights, property or security of any organization or individual. We may also use device identifiers, including IP addresses, to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. These disclosures may be carried out without notice to you.

 

Business transitions

We may share personal information with ClassForThat parent, subsidiaries and affiliates, primarily for business and operational purposes. If ClassForThat goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, bankruptcy, or other corporate change, including, without limitation, during any due diligence process, your information, including personal information, will likely be among the assets transferred. You will be notified via email and/or a prominent notice on the Platform of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information. This privacy policy will become binding upon the new owner of the information until amended.

 

Sweepstakes, contests and promotions

We may offer sweepstakes, contests, and other promotions ("Promotion") that may require registration. By participating in a Promotion, you are agreeing to governing terms, conditions or official rules, which may contain specific requirements of you, including allowing the sponsor(s) of the Promotion to use your name, voice, likeness or other indicia of persona in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, personal information, such as your name, email address and mailing address(es) may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.

 

Voluntary customer surveys

We may periodically conduct both business and individual customer surveys. We encourage our users to participate in these surveys because they provide us with important information that helps us to improve the types of services and classes we offer and how we provide them to you. Your personal information and responses will remain strictly confidential (except where required by law), even if a third party conducts the survey. Participation in our customer surveys is voluntary.

We take the information we receive from our users responding to our surveys and aggregate it with the responses from other users to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our services and classes offered to you, and to develop new services and products. This aggregated, non-personally-identifying information may be shared with third parties.

 

Employment Applications

If you apply for a job through the Platform, ClassForThat email or via its service provider, we or the service provider may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission ("EEOC") and other federal, state and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, ClassForThat or its service provider may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment related complaints.

 

Aggregated Statistics

We may collect statistics about the behavior of users in our Platform. We may display this information publicly or provide it to others. However, we do not disclose personally-identifying information other than as described in this Privacy Policy.

 

  1. Compromise of personal information

In the event that personal information is compromised as a result of a breach of security and ClassForThat becomes aware, ClassForThat will promptly notify those persons whose personal information has been compromised as it may see fit or as required by applicable law. You may, of course, decline to submit personal information through our Platform, in which case we may not be able to provide certain services to you. You may update or correct your account information at any time by logging in to your account.

We reserve the right to determine the form and means of providing notifications to you, provided that you may opt-out of certain means and types of notifications.

 

Email address and phone number

By providing ClassForThat your email address and phone number, you consent to our using the email address and/or phone number to send you Platform related notices and receipts, including any notices required by law, in lieu of communication by postal mail.

 

You also agree that we may send you notifications of activity on the Platform through the email address, via text message or through a phone call to the phone number you gave us, in accordance with any applicable privacy settings. We may use your email address and/or phone number to send you other messages, such as newsletters, changes to features of the Platform, or special offers. If you do not want to receive such email messages or texts, you may opt-out by selecting "unsubscribe" at the bottom of our email correspondences or send the word ‘STOP’ in our text correspondences. Opting out may prevent you from receiving email messages and/or texts regarding updates, improvements, or offers. You may not opt-out of Platform related calls, text messages and/or emails.

 

Push Notifications

We will also send you push notifications when accessing the Platform via our mobile applications, and only if you agree to receive them. We will use these notifications to announce special deals and to send you Platform related notices such as your itinerary when possible. You may opt-out of receiving these at any time by going to the phone settings and turning them off. You may not opt-out of Platform related push notifications.

 

  1. ClassForThat Live

We might offer live classes in the future and if you attend a live class through the Platform, other people who attend will be able to see your name, your image, your comments, your voice, and your profile. In addition, we may also broadcast the live class in the Platform and on our social media sites such as YouTube, Facebook, Instagram, Twitter, etc. In those instances, the general public may also be able to see your name, your image, your voice, and your comments (collectively referred to herein as the "Released Subject Matter"). By attending a live class, you hereby freely and without restraint consent to and give unto ClassForThat and its agents or assigns (the "Releases") the unrestrained right in perpetuity to own, utilize, or alter the Released Subject Matter, in any manner ClassForThat sees fit and for any purpose whatsoever, all of the foregoing to be without limitation of any kind. By participating in ClassForThat Live, you authorize the Releases and grant unto them the unrestrained rights to utilize the Released Subject Matter in connection with education, distribution, advertising, publicity, public displays, and exhibitions. You hereby stipulate that the Released Subject Matter is the property of the Releases to do with it as it will. You hereby waive to the fullest extent that you may lawfully do so, any causes of action in law or equity you may have or may hereafter acquire against the Releasees or any of them for libel, slander, invasion of privacy, defamation, copyright or trademark violation, right of publicity, or false light arising out of or in connection with the utilization by the Releasees or another of the Released Subject Matter. You release and indemnify the Releases from and against any claims arising from any breach of this warranty and the exercise of the rights granted herein.

 

  1. Closing Your Account

If you wish to close your account, send your request to hello@classforthat.com and we will close your account and remove your personal information when possible and if applicable, from the active databases of the Platform. Please send your request using an email account that you have registered with ClassForThat under your name.

 

Even if your account is closed, information may remain in backup records and we may retain all or certain data if it may be necessary to prevent fraud or future abuse or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery or if required by law. All retained data will continue to be subject to the applicable privacy policy for the Platform. Also, if you have posted content on or through the Platform, we may not be able to delete it.

 

  1. Children

ClassForThat does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register as users. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 is allowed to use our Platform or provide any personal information to or on ClassForThat. If we become aware that we have collected personal information from a child under the age of 13 without verification of parental consent, then we will delete that information as quickly as possible. We are not responsible for the practices employed by websites or applications linked to or from our Platform, nor the information or content contained therein. Please remember that when you use a link to go from our Platform to another website or social media site, our privacy policy is no longer in effect. Your browsing and interaction on any other website or application, including those that have a link on our Platform, is subject to that website's or application’s own rules and policies. Please read over those rules and policies before proceeding.

 

  1. Surveys and contests

From time to time we may request information via surveys and/or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include, among other personal information, contact information (such as name and address), and demographic information (such as zip code, age, etc). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of the Platform.

 

  1. Consent to transfer

The Platform is operated in the United States. If you are located outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using and accessing the Platform, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

We may update this privacy policy from time to time, so you should review this privacy policy periodically. When we change the privacy policy in a material way, we will update the ‘last modified’ date at the top of this privacy policy. Changes to this privacy policy are effective when they are posted on the Platform.   1. Credit Card Information

 

Credit Card Information

We use STRIPE, a secure third party company to process all credit cards transactions through our Platform. When you buy classes, your credit card information is not stored in ClassForThat Platform or servers. Stripe processes your credit card using Secure Socket Layer (SSL) technology. We cannot guarantee that Stripe’s security measures will prevent third-party "hackers" from illegally obtaining this information.

 

Credit Card Fraud Policy

In the unlikely event that you experience unauthorized use of your credit card, promptly report the fraudulent activity to your credit card company. Under the Fair Credit Billing Act, your liability may be limited for fraudulent charges. Please check with your credit card company to verify specific terms and conditions.

 

  1. Getting paid

In order to pay you for the classes you have thought, you will need to open an account in STRIPE by clicking the STRIPE button in your profile.

We will send your payments to your Stripe account so please make sure you keep your Stripe account information confidential so nobody else can access your account.

We cannot guarantee that STRIPE security measures will not prevent third-party "hackers" from illegally obtaining your Stripe account information.

 

  1. California Residents – California Privacy Rights

Under California Civil Code sections 1798.83-1798.84, residents of the State of California have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties' direct marketing purposes and the categories of personal information the company shares. Alternatively, the law provides that a company that has a privacy policy that provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for those third parties' direct marketing purposes may instead provide information on how to exercise that choice. ClassForThat qualifies for the alternative option; as stated above in this Privacy Policy, ClassForThat provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you choose to opt-out at the time ClassForThat offers that choice, ClassForThat does not share your information with that identified third party for its direct marketing purposes.

We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

If you are a minor under 18 and have a profile on our Platform, you may ask us to remove reviews or other content that you posted on the site by emailing us at hello@classforthat.com. We will begin to process your request within 30 days. Please note that processing your request does not ensure complete or comprehensive removal of content that you posted.
